Terms of contract / scope of application
These General Terms and Conditions (hereinafter: GTC) apply to all patients who utilise the services of Carole Berger; This includes all services offered by Massage Practice Carole Berger. By making an appointment, the patient recognises these General Terms and Conditions and the current price lists of the Carole Berger Massage Practice;

Prerequisite for the conclusion of the contract
The treatment contract is concluded when the client accepts the offer of Massage Practice Carole Berger and contacts Massage Practice Carole Berger for the purpose of counselling, anamnesis and treatment; The Massage Practice Carole Berger is entitled to refuse a treatment contract without giving reasons if the necessary relationship of trust cannot be expected.

Place of fulfilment
The place of fulfilment is the respective massage practice of Carole Berger

Content of the treatment contract
Carole Berger provides her services to the client in such a way that she applies her knowledge and skills for the purpose of practising medical massage for the education, counselling, anamnesis and therapy of the client; The Carole Berger Massage Practice is authorised to use the methods that correspond to the patient’s presumed wishes, unless the client makes a decision to the contrary; The patient’s subjective expectation of success cannot be promised or guaranteed; The Carole Berger Massage Practice is not authorised to prescribe sick notes or prescription medication; Please note that no diagnoses or treatments in the conventional medical sense are carried out; Therapy with Carole Berger cannot replace conventional medical treatment in every case; Ongoing conventional medical treatment should not be discontinued without consulting a doctor;

Disclaimer
If, despite professional application, consequential damage occurs which is attributable to the fact that the client has concealed reasons for excluding the corresponding therapy, the Massage Practice Carole Berger is exempt from any liability; The same applies to damages that arise because a reason for exclusion was not known to the customer and was not recognisable to Massage Praxis Carole Berger; Otherwise, liability for slight negligence is completely excluded; The Massage Practice Carole Berger accepts no liability for lost or damaged items on the practice premises;

Appointments and cancellations
Agreed appointments (electronically, by telephone or in person) are binding for both parties and must be adhered to; If an appointment cannot be kept, it must be cancelled by the respective party immediately, but no later than 24 hours before the start of the appointment, in writing or by telephone. If the appointment is not cancelled within the above-mentioned period, the patient shall bear the costs according to the price list for a missed appointment;

Confidentiality and data protection
The Carole Berger Massage Practice treats patient data confidentially and protects it as far as possible against access by third parties and only provides information about the patient’s medical history, consultations and treatment, as well as the accompanying circumstances and personal circumstances of the patient, with the express consent of the patient;

Payments / Fee
The Carole Berger Massage Practice concludes its contracts with individual clients, patients It is the patient’s responsibility to clarify whether their health insurance will cover the treatment costs; If this is not the case, he is personally liable in full for all costs. Payment is made via the billing organisation Ärztekasse.
